End User License Agreement

This agreement is between Miftode Vasilica, a private individual resident in Romania ("we", "us"), and the organisation that installs or uses Gherkin Studio for Jira ("you"). By installing or using the app you accept this agreement. If you accept on behalf of an organisation, you confirm you may bind it.

1. The app and Atlassian

1.1 Gherkin Studio for Jira ("the App") is an Atlassian Forge app distributed through the Atlassian Marketplace. 1.2 The Atlassian Marketplace Terms of Use apply alongside this agreement. Atlassian handles ordering, billing, taxes and refunds. We do not sell the App directly. 1.3 Atlassian is not a party to this agreement and is not responsible for the App.

2. Licence

2.1 While you have a valid subscription (or trial), we grant you a non-exclusive, non-transferable licence to use the App with your Atlassian Cloud site, for the number of users you pay for through Atlassian. 2.2 You may not copy, resell, sublicense, reverse engineer (except where the law allows it), or use the App to build a competing product. 2.3 We keep all rights in the App. You keep all rights in your data, including your scenarios and test results.

3. Your data

3.1 How we handle your data is described in our Privacy Policy at https://gherkinstudio.com/privacy, which forms part of this agreement. 3.2 Optional features send data outside Atlassian only after you switch them on: Git sync (to the Git provider and repository you configure) and AI drafts (to Anthropic, using the API key you provide). You are responsible for having the right to send that data to those services and for your agreements with them.

4. Fees

4.1 Fees, trials and discounts are those shown on the Marketplace listing at the time of purchase and are charged by Atlassian. 4.2 We announce price changes on the listing at least 60 days in advance. Changes apply from your next renewal.

5. Support and changes

5.1 We provide support as described at https://gherkinstudio.com/contact, on a reasonable-efforts basis, with no guaranteed response time unless agreed in writing. 5.2 We may update the App. We will not remove a core feature (the scenario editor, Git sync, test results, import) during a paid term without giving at least 30 days' notice.

6. No warranty

The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not promise the App will be error-free or uninterrupted. Keep your .feature files under version control (Git sync helps with that).

GIT SYNC NEVER DELETES FILES IN YOUR REPOSITORY. It only creates and updates the .feature file of each issue. When an issue moves to another project, its key changes and the next sync writes a new file under the new key; THE OLD FILE STAYS IN YOUR REPOSITORY UNTIL YOU DELETE IT. The App shows a notice with the old file's path on the moved issue. YOU ARE RESPONSIBLE FOR DELETING OR KEEPING THAT FILE, AND FOR ANY EFFECT OF IT STAYING (FOR EXAMPLE, CI RUNNING THE SAME SCENARIOS TWICE), WHETHER OR NOT YOU READ THE NOTICE OR THIS PARAGRAPH.

7. Limitation of liability

7.1 Our total liability arising out of or relating to this agreement or the App, in contract, tort or otherwise, is limited to the fees you actually paid for the App in the 12 months before the event giving rise to the claim. If you used the App only for free, our total liability is limited to EUR 50. 7.2 We are not liable for indirect, incidental, special or consequential damages, loss of profits, revenue, data or goodwill, even if advised of the possibility. 7.3 Nothing in this agreement limits liability that cannot be limited by law, including for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by negligence.

8. Term and ending

8.1 This agreement lasts while you use the App. It ends automatically when your subscription ends or you uninstall the App. 8.2 We may end it if you materially breach it and do not fix the breach within 30 days of notice. 8.3 After it ends, Atlassian's Forge platform deletes the App's stored data according to Atlassian's retention rules. Your .feature files in your own Git repository are not affected.

9. General

9.1 Romanian law governs this agreement, excluding its conflict-of-laws rules. The courts of Bacău, Romania have jurisdiction, unless mandatory consumer or local law says otherwise. 9.2 If one clause is invalid, the rest stays in force. 9.3 We may transfer this agreement to a company we control or to a buyer of the App, and will tell you if we do. 9.4 Contact: support@gherkinstudio.com.
